v.

PINELLAS COUNTY SHERIFF'S OFFICE, Respondent.

PERC denies the motion to reconsider its order of March 28, 2003. The representation/certification petition lacked the statutorily required thirty percent showing of interest. The showing of interest cards supporting the petition authorized two different registered employee organizations to represent the same employees.The Commission concluded that only those cards authorizing the petitioner to act as the collective bargaining agent would be counted when determining the sufficiency of the showing of interest. It will not deviate from its ruling.

Election results and order certifying unit No. 1389 for assistant chief-shift commander. Three eligible voters cast three ballots for the union.

NORTHEAST FLORIDA PUBLIC EMPLOYEES' LOCAL 630, LIUNA, AFL-CIO, Petitioner,

CITY OF ATLANTIC BEACH, Respondent.

Election results and order certifying unit No. 1388 for "regular full-time and regular part-time employees in the classifications of accountant, accounts payable clerk, administrative assistant to the director of parks and recreation, animal control officer, code enforcement officer, computer network technician, customer service representative, deputy building official, emergency communications operator, police records clerk, police records specialist, property/evidence/records clerk, public works inspector, purchasing agent, receptionist/assistant permits clerk, records clerk (city clerk's office), recreation coordinator, recreational leader, secretary (city clerk's office), special project manager, technician designer, and utility billing specialist." 26 eligible voters cast 14 ballots for and 9 against the union.

NORTHEAST FLORIDA PUBLIC, EMPLOYEES LOCAL 630, LIUNA, AFL-CIO,

CITY OF ATLANTIC BEACH, Respondent.

Election results and order dismissing the petition to represent "All regular full-time employees in the classifications of administrative assistant to the directors of public works and of public utilities, administrative assistant police/fire, beautification division chief, building permits technician/clerk II, computer network administrator, conveyance division director, customer service supervisor, deputy finance director, emergency communication operator supervisor, maintenance/streets division director, park maintenance division director, plant division director, utility billing supervisor, wastewater plants superintendent, and water plants superintendent." 15 eligible voters cast 6 ballots for and 6 against the union.

FINAL ORDER APPROVING SETTLEMENT AGREEMENT

The FSU Board of Trustees is directed to cease and desist from maintaining an overly broad no-solicitation rule; prohibiting employees from using e-mail to send union messages on non-work time and in any like or related manner interfering with, restraining, or coercing bargaining unit members in the exercise of any rights guaranteed them under Chapter 447, Park II, Fla. Stat.
